Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website located at 6ixstudio.ca and the services provided by 6ix Studio ("Company," "we," "our," or "us"), based in Brampton, Ontario, Canada. By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Services

6ix Studio provides digital services including, but not limited to, website design and development, booking and payment system integration, social media management, and local SEO optimization. Specific deliverables, timelines, and pricing for each engagement are outlined in a separate written agreement or proposal provided to the client prior to commencement of work.

2. Client Responsibilities

To enable us to deliver services effectively, you agree to:

  • Provide accurate, complete, and timely information requested by 6ix Studio
  • Supply necessary access credentials, brand assets, and approvals within agreed timeframes
  • Designate a primary point of contact authorized to make decisions on behalf of your business
  • Review and provide feedback on deliverables within the timeframes specified in your agreement
  • Ensure that any content, materials, or information you provide does not infringe on third-party intellectual property rights

3. Payment Terms

Payment terms are as follows unless otherwise specified in your written agreement:

  • Website Builds: 50% deposit required before work commences; remaining 50% due upon delivery of the completed project.
  • Monthly Retainers: Invoiced at the beginning of each monthly period; payment due within 14 days of invoice date.
  • Late Payments: Invoices unpaid after 30 days may incur a 1.5% monthly late fee. 6ix Studio reserves the right to pause services on accounts with outstanding balances exceeding 30 days.
  • All prices are in Canadian Dollars (CAD) unless explicitly stated otherwise.

4. Revisions and Scope

Each service package includes a specified number of revision rounds as outlined in your agreement. Revisions that fall outside the agreed scope — including new feature requests, additional pages, or significant changes in direction after approval — will be quoted separately and billed at our standard hourly rate. 6ix Studio will notify you in writing before proceeding with any out-of-scope work.

5. Intellectual Property

  • Client Content: You retain ownership of all content, trademarks, logos, and materials you provide to us.
  • Deliverables: Upon receipt of full payment, ownership of the final website and creative assets developed specifically for you transfers to the client. Third-party assets (fonts, stock images, plugins, themes) are subject to their respective licenses and are not transferred.
  • Portfolio Rights: 6ix Studio reserves the right to display completed work in our portfolio, case studies, and marketing materials unless you request in writing that we keep the engagement confidential.
  • Proprietary Tools: Any proprietary frameworks, templates, processes, or tools developed by 6ix Studio remain our intellectual property.

6. Cancellation and Termination

  • Monthly Retainers: Either party may terminate a retainer with 30 days written notice. You will be billed for services rendered up to the termination date.
  • Project Cancellation: If a website build project is cancelled after commencement, the deposit is non-refundable. If cancellation occurs after the 50% milestone, you will be invoiced for work completed to date at our standard rate.
  • Termination for Cause: 6ix Studio may immediately terminate your engagement if you breach these Terms, fail to pay invoices, or engage in conduct that is abusive, illegal, or harmful.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement. This includes business strategies, financial data, customer information, and technical specifications. This obligation survives termination of the agreement for a period of two (2) years.

8. Warranties and Disclaimers

6ix Studio warrants that services will be performed in a professional and workmanlike manner. However:

  • We do not guarantee specific business outcomes, revenue increases, search engine rankings, or social media growth as these depend on factors outside our control.
  • Websites and digital assets are provided "as is" following client approval. We are not responsible for issues arising from client-made modifications after delivery.
  • We are not liable for downtime, data loss, or service interruptions caused by third-party hosting providers, platforms, or external tools.

9. Limitation of Liability

To the maximum extent permitted by applicable law, 6ix Studio's total liability to you for any claims arising from or related to our services shall not exceed the total fees paid by you to 6ix Studio in the three (3) months preceding the claim. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless 6ix Studio and its representatives from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your use of our services, or your violation of any third-party rights.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Ontario, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
